King, Surveyor, under date of November, 1972, a copy of said plat being of record in Plat Book 4, Page 185, Clerks Office, Superior Court of Banks County, Georgia, as follows: BEGINNING at the most Northeasterly corner of the tract hereby conveyed, the same being an iron pin corner on the West right of way of Baldwin Falls Road, common with lands of Lewallen and running thence with the West right of way of said road the following three courses and distances: South 34 degrees 10 minutes West 91.7 feet to iron pin, South 19 degrees 25 minutes West 47 feet to iron pin, and South 4 degrees 02 minutes West 367.5 feet to iron pin corner; thence with the line of Sam McDuffie, South 59 degrees 06 minutes West 644.1 feet to iron pin corner, the same being the original corner of Land Lots Nos. 185, 186, 203 and 204; thence with the line of Ed Chapman, North 20 degrees 42 minutes East 255 feet to iron pin corner; thence North 18 degrees 56 minutes East 119 feet to iron pin corner; thence with the line of Lewallen, North 47 degrees 56 minutes East 693.3 feet to the beginning corner, containing 3.86 acres, more or less. The debt secured by said Security Deed is evidenced by a note dated September 17, 2003, in the principal amount of $54,750.00, as modified by Home Equity Modification Agreement dated November 21, 2023, payable, principal and interest from the date thereof shown on said Note on the unpaid balance until paid. Default has occurred in the payment of the debt evidenced by the Note and secured by the Security Deed as a result of the nonpayment of installments owed thereunder. The total balance of said debt has, therefore, been declared due and the Security Deed foreclosable according to its terms. The debt remaining in default, the property will be sold to the highest bidder for cash as the property of Donna Bonita Latty, the proceeds to be applied to the payment of said indebtedness, attorneys fees (notice of intention to collect attorneys fees having been given), and the lawful expenses of said sale, all as provided in the Note and the Security Deed, said sale to be subject to any and all unpaid taxes and assessments, and restrictions, easements and liens of record with priority over the Security Deed referenced above.
